Welcome to Tesoro Gem LLC (“Tesoro Gem,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website and the purchase of our jewelry products and services. By placing an order with Tesoro Gem LLC, you agree to be bound by these Terms. Please review them carefully prior to purchase.

1. General Terms

1.1. By using our website or purchasing from Tesoro Gem LLC, you confirm that you are at least 18 years of age or have the consent of a legal guardian.
1.2. These Terms constitute a legally binding agreement between you (“Customer”) and Tesoro Gem LLC (“Company”).
1.3. Tesoro Gem LLC offers two types of purchases:

  • Ready-to-Wear Jewelry (finished pieces sold as-is, without customization)
  • Custom Jewelry (designed and created specifically for the Customer)

2. Ready-to-Wear Jewelry (Finished, Non-Custom)

2.1. Product Description

Ready-to-Wear jewelry consists of completed, in-stock pieces sold as-is with no customization, modification, or personalization.

2.2. Return Eligibility

  • Ready-to-Wear purchases may be returned within 10 days of purchase only if a verifiable manufacturing defect is present.
  • Proof of defect (such as clear photographs or video) must be provided and approved by the Company.

2.3. Non-Returnable Conditions

Ready-to-Wear items are not eligible for return if:

  • The return is based on personal preference, change of mind, styling, or fit issues
  • The item shows signs of wear, damage, alteration, or misuse
  • The defect is due to improper care or handling after delivery

2.4. Approved Returns

  • If a return is approved, Tesoro Gem LLC may, at its discretion, repair, replace, or refund the item.
  • Shipping costs related to returns are the Customer’s responsibility unless otherwise agreed to in writing.

3. Custom Jewelry Orders & Commitment Fee

3.1. Commitment Fee Requirement

A non-refundable $50 commitment fee is required before Tesoro Gem LLC begins work on any custom jewelry order.

  • This fee confirms the Customer’s intent to proceed.
  • The commitment fee will be applied toward the final purchase price.

3.2. Order Process

  • Design, material sourcing, and production will not begin until the commitment fee has been received.
  • Upon payment, the Customer will receive order confirmation and an estimated production timeline.

3.3. Non-Refundable Commitment Fee

If the Customer chooses not to proceed with the custom order for any reason, the $50 commitment fee is non-refundable under all circumstances.

4. Final Sale Policy (Custom Jewelry)

4.1. All custom jewelry purchases are final. Due to the personalized nature of custom work, no refunds, returns, or exchanges are permitted.
4.2. Customers are solely responsible for reviewing and approving all design details, specifications, and measurements prior to final production.

5. Quality Assurance (Custom Jewelry)

5.1. Tesoro Gem LLC guarantees high-quality materials and professional craftsmanship.
5.2. Verified manufacturing defects will be repaired or corrected at no cost to the Customer.
5.3. Any quality concerns must be reported within 7 days of delivery and must include supporting documentation.

6. Exclusions to Repairs or Remakes

6.1. Repairs, alterations, or remakes resulting from:

  • Design dissatisfaction
  • Sizing preferences
  • Aesthetic expectations

are not covered by the Company.
6.2. Tesoro Gem LLC is not responsible for damage caused by wear and tear, misuse, improper care, or external factors beyond our control.

7. Repair & Maintenance

7.1. Repairs unrelated to manufacturing defects will be evaluated on a case-by-case basis and may incur additional fees.
7.2. Customers are responsible for all shipping costs related to repairs or maintenance unless otherwise stated in writing.

8. Limitation of Liability

8.1. Tesoro Gem LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products.
8.2. The Company’s maximum liability shall not exceed the purchase price of the item in question.

9. Intellectual Property

9.1. All designs, images, concepts, text, and materials displayed on the website are the intellectual property of Tesoro Gem LLC and may not be copied, reproduced, or used without prior written consent.

10. Governing Law & Jurisdiction

10.1. These Terms shall be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
10.2. Any disputes shall be resolved exclusively in the state or federal courts located in New Jersey.

Customer Agreement

By placing an order—whether for Ready-to-Wear or Custom Jewelry—you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
