Welcome to Tesoro Gem LLC! These Terms and Conditions govern your use of our website and services for custom jewelry. By placing an order with us, you agree to these terms. Please read them carefully before proceeding with your purchase.

1. General Terms

1.1. By using our website or purchasing from us, you confirm that you are at least 18 years old or have the consent of a legal guardian.
1.2. These Terms and Conditions constitute a binding agreement between you ("Customer") and Tesoro Gem LLC ("Company").

2. Custom Orders & Commitment Fee

2.1. Commitment Fee Requirement:

A non-refundable $50 commitment fee is required before Tesoro Gem LLC begins working on any custom order.

This fee demonstrates the Customer’s commitment to proceeding with the order.

The $50 commitment fee will be applied toward the final purchase price of the custom jewelry.

2.2. Order Process:

The Company will not start designing, sourcing materials, or production until the commitment fee has been received.

After the commitment fee is paid, the Customer will receive an order confirmation and production timeline.

2.3. Non-Refundable Commitment Fee:

If the Customer decides not to proceed with the order, the $50 commitment fee will not be refunded under any circumstances.

3. Final Sale Policy

3.1. All purchases are final. Due to the custom nature of our products, refunds, returns, or exchanges are not permitted under any circumstances.
3.2. It is the Customer's responsibility to review and confirm all design details before placing an order.

4. Quality Assurance

4.1. The Company guarantees that all products will be crafted with high-quality materials and workmanship.
4.2. If there are any manufacturing defects or quality issues, the Company will repair or fix the item free of charge.
4.3. Customers must notify the Company of any quality concerns within 7 days of receiving the product, along with proof of the issue (e.g., photos).

5. Exclusions to Repairs or Remakes

5.1. Repairs, alterations, or remakes due to customer dissatisfaction with the product's design, size, or appearance will not be made at the Company’s expense.
5.2. The Company will not be liable for damages or issues resulting from customer mishandling, improper care, or external factors beyond the Company’s control.

6. Repair and Maintenance Policy

6.1. Repairs for issues not related to manufacturing defects will be assessed on a case-by-case basis and may incur additional costs.
6.2. Customers are responsible for shipping costs associated with repairs or maintenance unless explicitly waived by the Company.

7. Liability Disclaimer

7.1. The Company is not responsible for any indirect, incidental, or consequential damages resulting from the use or inability to use our products.
7.2. The maximum liability of the Company for any claim shall not exceed the purchase price of the item in question.

8. Intellectual Property

8.1. All designs, materials, and content on the website are the intellectual property of Tesoro Gem LLC and may not be reproduced, copied, or used without prior written consent.

9. Governing Law and Jurisdiction

9.1. These Terms and Conditions are governed by the laws of the State of New Jersey, without regard to its conflict of law principles.
9.2. Any disputes arising under these Terms and Conditions shall be resolved exclusively in the state or federal courts located in New Jersey.

Customer Agreement
